A widow and her teenage children are taking legal action over the death of their husband and father during an Army training exercise.

Warrant Officer Neil Tattersall, 50 years old, suffered a cardiac arrest in Stubai in Austria in 2023 while skiing.

Mrs Tattersall claims the Army was negligent in failing to carry out any risk assessment before he undertook the altitude training in the Alps.

He had a medical history including chronic obstructive pulmonary disease.

He also suffered respiratory problems, high cholesterol and had a BMI of 32.

In 2014 he was graded “medically limited deployable”, but this was upgraded to “medically fully deployable” in 2021.

The MoD says that Mr Tattersall would have been likely to suffer a similar fatal cardiac arrest even if he hadn’t taken part in the skiing exercise.

“Our thoughts and sympathies remain with Warrant Officer Neil Tattersall’s family and loved ones,” said the MOD.

The family is seeking £250,000 in damages.

53-year-old Odette Tattersall from Suffolk, is seeking compensation for herself and the couple’s children Erin, 17, and Theo, 14.
